Curotiva – Licensed Therapy & Emotional Support Platform

1. Who We Are

Curotiva Services Private Limited (“Curotiva”, “Company”, “we”, “us”, “our”) owns and operates:

  • www.curotiva.com (“Website”)

  • The Curotiva mobile application (“App”)

  • All associated features, services, and digital infrastructure

(collectively, the “Platform”).

Curotiva operates a technology-based intermediary platform that:

  • Lists independent licensed therapists, certified counselors, and peer support listeners (“Professionals”);

  • Enables users to discover, book, and pay for sessions;

  • Provides access to digital emotional wellness resources and community features (“Platform Services”).

Important Clarification

Curotiva:

  • Does not provide therapy, medical treatment, psychiatric care, or diagnosis.

  • Does not provide emergency or crisis intervention services.

  • Does not supervise or control Professional Services.

Professional services rendered by listed Professionals (“Professional Services”) are independently provided by such Professionals. A separate professional-client relationship is formed directly between the User and the Professional.

Curotiva acts solely as an intermediary technology platform.


2. Acceptance of Terms

These Terms constitute a legally binding agreement between:

  • You (“User”, “you”, “your”); and

  • Curotiva Services Private Limited.

By:

  • Accessing the Platform

  • Creating an account

  • Booking sessions

  • Making payments

  • Using any Platform feature

you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must immediately discontinue use of the Platform.


3. Nature of the Platform

Curotiva is:

  • A technology intermediary under Indian law

  • A booking and payment facilitation service

  • A digital discovery and scheduling platform

Curotiva is NOT:

  • A hospital

  • A medical establishment

  • A mental health clinic

  • A licensed healthcare provider

  • An emergency response provider

Professionals listed may include:

  • RCI-registered Clinical Psychologists

  • Certified Counselors (non-RCI)

  • Peer Support Listeners (non-clinical)

Professional category is clearly identified on each profile.


4. No Medical or Emergency Services

The Platform does not provide:

  • Medical diagnosis

  • Prescription services

  • Psychiatric emergency services

  • Crisis response

If you are experiencing:

  • Suicidal ideation

  • Severe mental health crisis

  • Immediate danger

  • Medical emergency

You must contact local emergency services or a qualified medical provider immediately.

Curotiva bears no responsibility for crisis management.


5. Eligibility

You must be at least 18 years old to:

  • Register an account

  • Book sessions

  • Make payments

Minors may use the Platform only:

  • With verified parental or legal guardian consent

  • Under guardian supervision

Parents/guardians assume full responsibility for minor usage.

Curotiva reserves the right to suspend accounts for age misrepresentation.


6. Account Responsibilities

You agree to:

  • Provide accurate and complete information

  • Maintain confidentiality of credentials

  • Notify us of unauthorized access

  • Not impersonate another person

You are responsible for all activity under your account.


7. Professional Verification & Categories

Curotiva collects and reviews documentation submitted by Professionals. However:

  • Verification is limited to documentation review

  • Curotiva does not independently validate regulatory standing beyond submitted documents

  • Curotiva does not guarantee professional outcomes

Users are responsible for selecting Professionals at their discretion.


8. Professional Services Disclaimer

Professional Services:

  • Are independently provided

  • Are not services of Curotiva

  • Create a direct professional-client relationship between User and Professional

Curotiva:

  • Does not control session content

  • Does not supervise therapy sessions

  • Is not liable for advice or treatment provided

Users acknowledge that reliance on Professional Services is at their own risk.


9. Payments and Billing

9.1 Digital Services

All session bookings and digital content are considered digital services.

For Android devices distributed via Google Play, payments shall be processed through Google Play Billing as required by platform policies.


9.2 Platform Role

Curotiva:

  • Facilitates payment collection

  • May deduct a platform commission

  • Remits remaining fees to Professionals

Curotiva is not a financial institution.


9.3 Refund Policy

Refunds may be considered in cases of:

  • Professional cancellation

  • Verified technical failure

  • Duplicate payment

Refund eligibility is determined at Curotiva’s reasonable discretion in accordance with platform policy.

No refunds are guaranteed for completed sessions.


10. Cancellation & No-Show

Users must cancel within the stated cancellation window.

Failure to attend a session may result in:

  • No refund

  • Partial refund

  • Platform warnings

  • Account suspension for repeated misuse


11. Prohibited Conduct

You agree not to:

  • Harass or abuse Professionals

  • Record sessions without explicit consent

  • Share unlawful or harmful content

  • Attempt to bypass platform payment systems

  • Solicit Professionals off-platform to avoid fees

  • Reverse engineer or exploit the Platform

Violations may result in suspension, termination, or legal action.


12. Intellectual Property

All Platform materials including:

  • Branding

  • Logos

  • Software

  • Designs

  • Written content

  • Audio/visual material

are owned by or licensed to Curotiva.

No reproduction or redistribution is permitted without written consent.


13. Privacy

Use of the Platform is governed by our Privacy Policy.

While reasonable safeguards are implemented, no digital system guarantees absolute security.


14. Limitation of Liability

To the maximum extent permitted by law:

Curotiva shall not be liable for:

  • Professional negligence

  • Clinical outcomes

  • Emotional distress

  • Indirect or consequential damages

  • Loss of profits or business

Total aggregate liability shall not exceed the total amount paid by you to Curotiva in the preceding three (3) months.

Nothing in these Terms excludes liability where such exclusion is prohibited by law.


15. Indemnification

You agree to indemnify and hold harmless Curotiva, its directors, officers, and employees from claims arising out of:

  • Your misuse of the Platform

  • Violation of these Terms

  • Disputes with Professionals


16. Suspension & Termination

Curotiva may suspend or terminate access if:

  • Terms are violated

  • Fraud is suspected

  • Required by law

  • Directed by government authority

Termination does not waive accrued rights or liabilities.


17. Force Majeure

Curotiva shall not be liable for failure or delay caused by events beyond reasonable control, including:

  • Natural disasters

  • Internet outages

  • Government restrictions

  • Cyberattacks

  • War or civil unrest


18. Electronic Record & IT Compliance

These Terms are published in compliance with:

  • Information Technology Act, 2000

  • Intermediary Guidelines & Digital Media Ethics Code Rules, 2021

This document constitutes an electronic record and does not require physical signature.


19. Dispute Resolution & Arbitration

Any dispute arising out of these Terms shall be resolved through:

  1. Good faith negotiation

  2. Failing which, binding arbitration under the Arbitration and Conciliation Act, 1996

Seat of arbitration: Nagpur, India
Language: English

Courts at Nagpur shall have exclusive jurisdiction for interim relief.


20. Governing Law

These Terms shall be governed by the laws of India.


21. Changes to Terms

We may update these Terms at any time.

Updated Terms become effective upon publication.

Continued use constitutes acceptance.
